I. PRIVACY AND DATA PROTECTION POLICY

In compliance with applicable legislation, Autoflou (hereinafter also referred to as the “Website”) undertakes to adopt the necessary technical and organizational measures, according to the appropriate level of security for the risk associated with the data collected.

Laws incorporated into this Privacy Policy

This Privacy Policy is adapted to the current Spanish and European regulations regarding the protection of personal data on the Internet. In particular, it complies with the following regulations:

  • Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (GDPR).

  • Organic Law 3/2018, of 5 December, on the Protection of Personal Data and Guarantee of Digital Rights (LOPD-GDD).

  • Royal Decree 1720/2007, of 21 December, approving the Regulation implementing Organic Law 15/1999, of 13 December, on the Protection of Personal Data (RDLOPD).

  • Law 34/2002, of 11 July, on Information Society Services and Electronic Commerce (LSSI-CE).

Personal Data Processing Records

In compliance with the GDPR and the LOPD-GDD, we inform you that personal data collected by Autoflou through the forms available on its pages will be incorporated and processed for the purpose of facilitating, streamlining and fulfilling the commitments established between Autoflou and the User, maintaining the relationship established through the forms completed by the User, or responding to a request or enquiry.

Likewise, in accordance with the GDPR and the LOPD-GDD, unless the exception provided for in Article 30(5) of the GDPR applies, a record of processing activities shall be maintained specifying, according to their purposes, the processing activities carried out and the other circumstances established by the GDPR.

Principles Applicable to the Processing of Personal Data

The processing of the User's personal data shall be subject to the principles established in Article 5 of the GDPR and Article 4 and subsequent articles of Organic Law 3/2018, of 5 December, on the Protection of Personal Data and Guarantee of Digital Rights:

  • Principle of lawfulness, fairness and transparency: the User's consent shall be required where applicable, after providing fully transparent information about the purposes for which personal data is collected.

  • Purpose limitation principle: personal data shall be collected for specified, explicit and legitimate purposes.

  • Data minimization principle: personal data collected shall be limited to what is strictly necessary in relation to the purposes for which it is processed.

  • Accuracy principle: personal data must be accurate and kept up to date.

  • Storage limitation principle: personal data shall only be kept in a form that permits identification of the User for as long as necessary for the purposes of processing.

  • Integrity and confidentiality principle: personal data shall be processed in a manner that ensures appropriate security and confidentiality.

  • Accountability principle: the Data Controller shall be responsible for ensuring compliance with the above principles.

Categories of Personal Data

The categories of data processed by Autoflou are identification and contact data.

Autoflou does not intentionally collect or process special categories of personal data within the meaning of Article 9 of the GDPR through its standard website forms.

Special categories of personal data include data revealing racial or ethnic origin, political opinions, religious or philosophical beliefs, trade union membership, genetic data, biometric data processed for the purpose of uniquely identifying a natural person, health data, or data concerning a person's sex life or sexual orientation.

Where the processing of special categories of personal data is required, explicit consent from the User for one or more specific purposes shall be required where applicable.

Legal Basis for the Processing of Personal Data

The legal basis for the processing of personal data is consent where processing relies on the User's consent.

Autoflou undertakes to obtain express and verifiable consent from the User for the processing of personal data for one or more specific purposes where such consent is legally required.

The User shall have the right to withdraw consent at any time. It shall be as easy to withdraw consent as it is to give it. As a general rule, withdrawal of consent shall not affect the use of the Website.

Where the User is required or permitted to provide personal data through forms in order to make enquiries, request information or for reasons related to the Website's content, the User shall be informed if completion of any field is mandatory because the information is necessary for the proper completion of the relevant operation.

Purposes for Which Personal Data Is Processed

Personal data is collected and managed by Autoflou for the purpose of facilitating, streamlining and fulfilling commitments established between the Website and the User, maintaining the relationship established through forms completed by the User, or responding to requests and enquiries.

Likewise, data may be used for commercial, personalization, operational and statistical purposes and for activities related to Autoflou's business, as well as for data analysis and storage and marketing studies aimed at adapting the content offered to Users and improving the quality, operation and navigation of the Website.

At the time personal data is obtained, the User shall be informed about the specific purpose or purposes for which the personal data will be processed; that is, the use or uses that will be made of the information collected.

Personal Data Retention Periods

Personal data shall only be retained for the minimum period necessary for the purposes for which it is processed or until the User requests its deletion, provided there is no legal obligation requiring Autoflou to retain such information.

At the time personal data is collected, the User shall be informed of the period for which the personal data will be stored or, where this is not possible, the criteria used to determine that period.

Recipients of Personal Data

The User's personal data may be processed by third-party service providers where necessary for the operation of the Website and Autoflou's services.

Where Autoflou intends to transfer personal data to a third country or international organization, Users will be informed where required about the relevant transfer and the safeguards applicable under data protection legislation.

Where applicable, such transfers shall be carried out in accordance with the requirements established by the GDPR.

Personal Data of Minors

In accordance with Article 8 of the GDPR and Article 7 of Organic Law 3/2018, only persons over the age established by applicable Spanish data protection legislation may independently provide valid consent for the processing of their personal data where consent is the applicable legal basis.

Where parental or guardian authorization is legally required, processing shall only be considered lawful to the extent that such authorization has been provided.

Confidentiality and Security of Personal Data

Autoflou undertakes to adopt the necessary technical and organizational measures, according to the appropriate level of security for the risk associated with the data collected, in order to guarantee the security of personal data and prevent the accidental or unlawful destruction, loss or alteration of personal data transmitted, stored or otherwise processed, or unauthorized disclosure of or access to such data.

The Website uses an SSL (Secure Socket Layer) certificate, which helps ensure that personal data transmitted between the server and the User is transmitted securely and confidentially through encryption.

However, because Autoflou cannot guarantee the absolute security of the Internet or the complete absence of unauthorized or fraudulent access, the Data Controller undertakes to communicate personal data breaches without undue delay where required under applicable law and where such a breach is likely to result in a high risk to the rights and freedoms of natural persons.

In accordance with Article 4 of the GDPR, a personal data breach means a breach of security leading to the accidental or unlawful destruction, loss, alteration, unauthorized disclosure of, or access to personal data transmitted, stored or otherwise processed.

Personal data shall be treated as confidential by the Data Controller, who undertakes to ensure, through legal or contractual obligations where applicable, that such confidentiality is respected by employees, associates and any other persons to whom access to the information is granted.

Rights Arising from the Processing of Personal Data

The User may exercise the following rights recognized under the GDPR and Organic Law 3/2018:

Right of access: The User has the right to obtain confirmation as to whether Autoflou is processing their personal data and, where applicable, to obtain information about such personal data and the processing carried out.

Right to rectification: The User has the right to request the correction of inaccurate personal data or, taking into account the purposes of processing, the completion of incomplete personal data.

Right to erasure (“right to be forgotten”): Subject to applicable legislation, the User has the right to request deletion of their personal data where the data is no longer necessary for the purposes for which it was collected or processed; where consent has been withdrawn and there is no other legal basis for processing; where the User objects to processing and there are no overriding legitimate grounds for continuing the processing; where the data has been unlawfully processed; or where deletion is required to comply with a legal obligation.

Right to restriction of processing: The User has the right to request restriction of the processing of personal data in the circumstances established by applicable data protection legislation.

Right to data portability: Where processing is carried out by automated means and the applicable legal requirements are met, the User has the right to receive personal data concerning them in a structured, commonly used and machine-readable format and to transmit that data to another controller.

Right to object: The User has the right to object to certain processing of their personal data by Autoflou in the circumstances established by the GDPR.

Right not to be subject to automated decision-making: The User has the right, where applicable, not to be subject to a decision based solely on automated processing, including profiling, which produces legal effects concerning them or similarly significantly affects them, except where permitted by applicable legislation.

Exercising Your Rights

Users may exercise their rights by sending a written request to Autoflou with the reference:

Where necessary, Autoflou may request additional information reasonably required to verify the identity of the person making the request.

Links to Third-Party Websites

The Website may include hyperlinks or links allowing Users to access third-party websites that are not operated by Autoflou.

The owners of those websites have their own data protection and privacy policies and are responsible for their own data processing activities and privacy practices.

Complaints to the Supervisory Authority

If the User believes that there is a problem or infringement of applicable regulations regarding the way in which their personal data is being processed, they have the right to effective judicial protection and to lodge a complaint with a supervisory authority, particularly in the Member State of their habitual residence, place of work or place of the alleged infringement.

In Spain, the supervisory authority is the Spanish Data Protection Agency (Agencia Española de Protección de Datos – AEPD).


II. ACCEPTANCE AND CHANGES TO THIS PRIVACY POLICY


Users should read the provisions regarding the protection of personal data contained in this Privacy Policy and, where consent is the applicable legal basis, provide such consent so that the Data Controller may process personal data in accordance with the purposes and conditions described in this Policy.

Autoflou reserves the right to modify this Privacy Policy at its discretion or as a result of legislative, regulatory, judicial or supervisory authority changes.

Users are encouraged to periodically review this page in order to remain informed about changes or updates.

This Privacy Policy has been prepared in accordance with Regulation (EU) 2016/679 (GDPR) and Organic Law 3/2018 on the Protection of Personal Data and Guarantee of Digital Rights (LOPD-GDD).
